pRINCIPLES

The data protection policy in GAMA OPTIC SMART SRL is based on the following data protection principles:

1. The processing of personal data will be done in a legal, fair and transparent manner;

2. The collection of personal data will only be done for specified, explicit and legitimate purposes and the data will not be further processed in a manner incompatible with those purposes;

3. The collection of personal data will be adequate, relevant and limited to the information necessary for the purpose of processing;

5. All reasonable steps will be taken to ensure that incorrect data is deleted or corrected without delay;

6. Personal data will be kept in a form that allows the identification of the person concerned and for a period no longer than that in which the personal data are processed;

8. Personal data will not be distributed to third parties unless necessary for the purpose of providing services according to the agreements;

9. Data subjects have the right to request access to personal data, their rectification and deletion, opposition or restriction of data processing as well as the right to data portability.

10. The personal data processed by GAMA OPTIC SMART SRL will be stored on secure devices, and the means of transport will also be secured.

Personal data. Definition.

"Personal data" means any information regarding an identified or identifiable natural person ("data subject"); an identifiable natural person is a person who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, telephone number, location data, an online identifier, or to one or more specific elements, specific to his physical, physiological, genetic, psychological, economic, cultural or social identity.

GAMA OPTIC SMART SRL customers who wish to benefit from our services and provide us with information may be asked to provide personal data so that GAMA OPTIC SMART SRL can operate and improve services and business. We prefer to collect offline, at work points, primarily personal data such as name, date of birth, addresses, e-mail addresses, telephone numbers, series and bulletin number, personal numerical code, medical history, medical data , for carrying out the activity of medical optics and medical services in the field of ophthalmology, on the legal basis of article 6.(chap. I) of law 679/2016 (GDPR), especially for the fulfillment of fiscal obligations and for following the medical evolution of each case.
Online, we mainly collect data necessary for consultation appointments (name, surname, phone number, e-mail address) and other specific data, such as IP address, cookie modules, for security reasons. Also online, we can collect data related to the online purchase of one or more products from our website, when this service will be available, in order to purchase, deliver (delivery address) and secure the transaction.
We also collect personal data for other purposes such as HR, statistics, research, marketing administration and communication, IT and security administration, physical security, authentication and authorization systems, support systems, collaboration on internal projects and organizational teams and activities. We will only process personal data for a specified, explicit and legitimate purpose.
For reasons of physical security, according to Law 40/2010 - for the amendment and completion of Law no. 333/2003, we also collect visual data (images, video) with our clients and employees, considering the obligation to install video surveillance systems regarding the protection of objectives, assets, values and the protection of people published in the Official Gazette 153/2010. This information will not be shared with any Authorized Representative of GAMA OPTIC SMART SRL, with the exception of the bodies of the Romanian State for combating and preventing theft, violence, discrimination, road accidents, etc.

Use of personal data

We will only use personal data for the purpose for which it was collected and store the data only as long as necessary for that purpose. We will retain the Customer's information for as long as the Customer's account is active, to provide services to the Customer, to comply with our legal obligations or for any of the purposes mentioned above. Access to personal data is strictly limited to the staff and authorized representatives of GAMA OPTIC SMART SRL, the company's subsidiaries and associates who have the necessary authorization and clearly defined need to use the data.

Use of cookies

The gama-optic.ro website and its partners use cookies or similar technologies to ensure the best experience for users and to analyze trends, administer the website, track the customer's use of the website and to collect demographic information about the user base as a whole. Cookies are small text files that are placed on the customer's device to track usage and record preferences. Our cookies do not contain information that can identify individuals. We collect certain information automatically through the use of cookies and tracking technologies such as Internet Protocol (IP) addresses, browser type, Internet Service Provider (ISP), referring/exit pages, pages viewed on our site ( e.g. HTML pages, graphics), operating system, date/time and/or series of clicks to analyze the trend as a whole and administer the site. Disclosure of personal data

Personal data will not be disclosed to third parties except in situations where disclosure is necessary to be able to offer our services. We will also disclose personal information if required by law, for example to comply with a subpoena or other legal process, when we believe in good faith that disclosure is necessary to protect our rights, the safety of our customers or the safety of others, the investigation fraud or in response to a government request.

Security of processing

We will process data securely, apply and maintain appropriate technical measures to protect personal data against accidental or unlawful destruction or loss, alteration, disclosure or unauthorized access, in particular when processing involves the transmission of data over a network both against any other form of unlawful processing.

Access and rectification or deletion of personal data

Customers have the right, provided that the request does not contravene Romanian fiscal legislation, to request at any time access to, rectification, deletion or restriction of the processing of the data collected by us. To help us keep personal data up to date, we encourage users to notify us of any changes or discrepancies. Personal recruitment

To apply for our jobs we use an external recruitment portal for management purposes. When you apply for a job within GAMA OPTIC SMART SRL your personal data will be processed and controlled by GAMA OPTIC SMART SRL. Applications will not be stored for longer than necessary and will not be disclosed to third parties. Digital marketing

GAMA OPTIC SMART SRL has the right to send marketing e-mails to customers only with their consent, registered either online or in physical offices. This specific form of consent must be freely given, specifically and precisely informed. These requests are fulfilled when customers have opted-in to receive marketing emails (have actively consented).

Customers will always have the right to object, upon request and free of charge, to the processing of personal data for direct marketing purposes without having to provide concrete justifications. Customers can do this by clicking on the "Unsubscribe" link that appears in the e-mail messages we send you, or they can send us a message at contact@gama-optic.ro. Once the customer has objected, that customer's personal data will no longer be processed for direct marketing. In terms of communications on social networks, GAMA OPTIC SMART SRL will never download personal data from the conversations there, but will use the security techniques of the respective platforms.

Any marketing e-mails contain information that we consider interesting for the customer, communications related to promotional campaigns specific to the products purchased by the Customer, as well as breaking news related to our products and services.

Responsibility

GAMA OPTIC SMART SRL is responsible and will be able to demonstrate at any time compliance with the GDPR as well as with the principles established in this document. GAMA OPTIC SMART SRL will maintain under its responsibility an archive of processing activities containing the information required by the GDPR and, where necessary, will make the information available to the supervisory authorities.

Personal data collected before 25.05.2018

Considering the paramedical nature of the activity, the personal data collected before the date of entry into force of the law 679/2016 (GDPR) will continue to be kept for the monitoring of the medical history, necessary for the proper development of the activity of GAMA OPTIC SMART SRL. These data will enjoy the same storage and transfer security to which all other personal data collected and processed by GAMA OPTIC SMART SRL are subject. Any person affected by the processing of personal data by GAMA OPTIC SMART SRL has the right to request the deletion, modification or portability of personal data from their records. A written request in this sense can be sent by e-mail to contact@gama-optic.ro, or completed, in physical format, to the address of any work point or sent by post to those addresses.

Claims

Customers have the right to file a complaint related to the processing of their personal data. All inquiries and complaints will be processed in a timely manner and in accordance with internal procedures.

In the unlikely event that customers have suffered damages due to the violation of rights according to the personal data protection policy and GAMA OPTIC SMART SRL did not handle the complaint properly, customers have the possibility to send a complaint to the higher authority.
